About DearTalesDearTales is a personalised animated story video service operated by Erum Khan, trading as DearTales, Suite RA01, 195–197 Wood Street, London E17 3NU.Contact: [email protected]2. Our serviceDearTales creates personalised animated story videos for children using information, preferences and photographs supplied by a parent, legal guardian or other person with appropriate authority.Artificial intelligence and other digital production tools may be used as part of the creative process, but each story is individually designed, directed, curated and quality checked by DearTales.The features, duration and personalisation included in your order depend on the package selected on deartales.co.uk.3. Placing an orderTo place an order, you:choose a DearTales story package on deartales.co.uk;
complete payment through our secure Stripe checkout; and
complete the DearTales personalisation form provided after payment.Your order is accepted once payment has been successfully processed.Production cannot begin until we have received the photographs, personalisation details and other information reasonably required to create the video.If the personalisation form is completed after payment, the estimated delivery period begins when we have received all required information and materials.We may contact you if information is missing, unclear or unsuitable for production.If we are unable to accept or fulfil your order, we will contact you and refund any payment received.4. PaymentPayment is required in full at the time of ordering.Payments are processed securely by Stripe. DearTales does not receive or store your full payment-card details.The amount charged will be the price displayed for the selected package at the time the order is placed.Your payment confirmation may be provided by Stripe and DearTales may also contact you using the email address supplied with your order.5. DeliveryCompleted videos are normally delivered to the email address supplied with the order within 5–7 working days after both:successful payment; and
receipt of all photographs, information and other materials required to create the story.Delivery may take longer where information is missing, clarification is required, or circumstances outside our reasonable control cause a delay.If we expect a significant delay, we will contact you.Any stated delivery period is an estimate unless we have expressly agreed a specific delivery date with you.6. Quality, satisfaction and revisionsWe want you to be delighted with your child’s DearTales story.If something in the finished video does not reasonably reflect the information supplied with your order, please contact us and we will consider reasonable revisions.Our revision commitment is intended to address matters such as significant inaccuracies in the supplied personalisation details, character presentation or production.It does not normally include:changing to an entirely different story or creative direction after production;
replacing information that was correctly used from the original submission; or
substantial additions that were not requested when the personalisation form was submitted.Nothing in this section limits your statutory consumer rights.Under UK consumer law, digital content must meet applicable standards including being as described and of satisfactory quality, and services must be carried out with reasonable care and skill.7. Cancellations and refundsBecause DearTales stories are individually created for a particular child, production may begin shortly after we receive your completed personalisation details.If you wish to cancel, please contact:[email protected]as soon as possible.Where production has not begun, we will normally provide a full refund, subject to any statutory rights and exceptions that apply.Starting production during the cancellation periodWhere UK consumer law gives you a statutory cancellation period and you ask DearTales to begin providing the personalised service before that period has ended, we will obtain any express request, consent or acknowledgement required by law.If you cancel after production has begun but before the service has been fully performed, you may be required, where permitted by law, to pay an amount proportionate to the work already carried out.Where a service has been fully performed during the statutory cancellation period following the required request and acknowledgement, your statutory cancellation right may end.Where digital content is supplied before the end of an applicable cancellation period, your cancellation rights may also be affected where you have given the express consent and acknowledgement required by law.These provisions do not affect your rights where the service or digital content is faulty, not as described or otherwise does not comply with applicable consumer law.DearTales will not impose cancellation charges that exceed what may lawfully and fairly be retained for work or losses actually incurred.Nothing in these Terms excludes or restricts your statutory consumer rights.8. Photographs and personal informationBy submitting photographs or personal information relating to a child, you confirm that:you are the child's parent or legal guardian, or otherwise have appropriate legal authority to provide the information and photographs;you have the right to provide the material to DearTales; andthe information and photographs may be used as reasonably necessary to create, administer and deliver the personalised order.Personal information and photographs are handled in accordance with our Privacy Policy.9. AI tools and third-party service providersDearTales uses selected third-party digital services, hosting services, payment providers and AI-assisted production tools to help create and deliver personalised videos.Only information reasonably required for the relevant purpose should be provided to those services.Further information about the types of providers we use, how personal information is handled and how long information may be retained is explained in our Privacy Policy.10. Intellectual property and permitted useThe completed DearTales video is supplied for your personal and family use.You may download, retain and share your completed video for personal, non-commercial purposes.You may not resell, commercially exploit or represent the video as your own commercial production without written permission from DearTales.DearTales retains its rights in its branding, production methods, general creative techniques, templates and non-identifying story concepts.We will not use an identifiable child's photograph or personalised video for advertising, promotional or public marketing purposes without appropriate permission.11. LiabilityNothing in these Terms excludes or limits any liability that cannot legally be excluded or limited, or any statutory rights available to you as a consumer.Subject to those rights, DearTales will not be responsible for losses that were not reasonably foreseeable when the contract was made or losses resulting from use of the service for business or commercial purposes.These Terms will not be interpreted in a way that removes or restricts rights that UK consumer law gives you. Consumer contract terms must be fair and cannot lawfully remove statutory rights relating to defective products, digital content or inadequate services.12. Governing lawThese Terms are governed by the laws of England and Wales.If you are a consumer living elsewhere, you may also benefit from mandatory consumer protections that apply in the country where you live.Nothing in these Terms prevents you from relying on consumer rights that cannot lawfully be excluded.13. We do not ask children to place orders or submit their own personal information.2. Information we collectWhen you place an order or contact us, we may collect your name and email address, order and payment information, your child’s name and age, information about your child’s appearance that you provide for character creation, photographs of your child, information or photographs relating to a pet, toy or other chosen companion, story preferences, themes, lessons, favourite colours and occasion details, birthday information where relevant, any additional information you choose to provide for personalisation, and communications you send to DearTales.We only ask you to provide information that is reasonably necessary to create and deliver the service you have requested.3. Payment informationPayments are processed securely by Stripe through our online order form.DearTales does not receive or store your full debit or credit card details. Stripe processes those details directly.We may retain limited transaction information such as the amount paid, payment status, date and transaction reference for order administration, refunds, accounting and legal purposes.4. How we use informationWe use personal information to process and manage your order, create your child’s personalised story, communicate with you about your order, process payments and refunds where necessary, deliver the completed video, respond to questions or complaints, maintain appropriate business and accounting records, protect the security of our systems and comply with our legal obligations.We do not sell your personal information or your child’s personal information.We do not use your child’s photographs or identifiable personalised video for advertising or marketing unless you have separately given us permission to do so.5. Children’s informationWe recognise that children’s personal information requires particular protection.Orders must be submitted by a parent, legal guardian or another adult who has authority to provide the child’s information and photographs.By submitting a child’s photograph or personal information, you confirm that you have the authority to provide it for the purpose of creating the requested DearTales story.We use children’s information only where reasonably necessary to create, deliver and support the personalised service requested by the adult placing the order.We do not sell children’s information or knowingly use it for direct marketing or advertising.6. Order forms and file uploadsOur online order form is provided through Tally.Information entered into the order form, including uploaded photographs, is processed through Tally so that we can receive and manage your order.We aim to remove children’s photographs and unnecessary personalisation information from our active business files and order systems when they are no longer reasonably required for production, delivery, revisions or resolving an issue with the order.7. AI and creative production toolsDearTales uses specialist artificial intelligence and digital production tools to help create personalised story videos. Every DearTales story is directed, curated and quality checked by a real person.Depending on the story and production process, tools may include Higgsfield AI for image and video generation, Kling AI for image and video animation, ElevenLabs for voice and audio generation, and Suno for music generation.We aim to provide each service only with information reasonably necessary for the particular production task.A child’s photograph may need to be processed by image or video generation services in order to create a personalised character. Voiceover and music services will normally receive text or production instructions rather than the child’s photograph unless this is required for a particular feature.Third-party AI providers operate under their own privacy policies and terms. Those terms may allow uploaded content or information to be retained or used to operate, develop or improve their services.Some AI providers may permit user content to be used for model development or training. DearTales does not control information once it has been processed within a third-party provider’s systems.We therefore encourage parents and guardians to consider this information carefully before submitting photographs.8. Other service providersWe also use third-party services to operate DearTales.These may include Carrd for website hosting, Tally for order forms and uploads, Stripe for secure payment processing, Microsoft 365 and GoDaddy for business email, Vimeo for embedded video content, and Meta for website advertising and measurement tools where enabled.These providers may process limited personal or technical information in order to provide their services.9. Cookies and website trackingOur website may use cookies and similar technologies required for the website to function and, where enabled, for analytics or advertising purposes.This may include technologies provided by third parties such as Meta.Where consent is required by law for non-essential cookies or tracking technologies, these technologies should only be activated after the appropriate consent has been obtained.You may withdraw or change your cookie choices where those controls are available.10. Our lawful bases for using personal informationWe use different lawful bases depending on why information is being processed.Where we process the adult customer’s information in order to take an order, receive payment, create and deliver the purchased service, our lawful basis is generally that the processing is necessary to perform our contract with you.We may rely on legitimate interests where reasonably necessary to operate and protect DearTales, respond to enquiries, prevent fraud or maintain appropriate business records, provided those interests do not override an individual’s rights and freedoms.Where children’s personal information is involved, we take additional care to consider and protect the child’s interests, rights and freedoms.Where we ask for consent for a particular optional use, for example permission to use an identifiable story or image for marketing, you may withdraw that consent.We may also process information where necessary to comply with a legal obligation.11. How long we keep informationWe do not keep children’s photographs and personalisation information indefinitely.We aim to delete children’s photographs and other production materials from our own active files when they are no longer reasonably necessary to create and deliver the story, complete agreed revisions or resolve an issue with the order.Certain customer, payment, transaction and accounting records may need to be retained for longer where required for tax, accounting, legal, fraud-prevention or dispute purposes.Where possible, unnecessary children’s information will not be retained simply because an adult customer’s financial record must be kept.Third-party providers may retain information for different periods under their own privacy policies and terms. DearTales cannot guarantee deletion from a third-party provider where that provider’s terms or technology do not permit it.12. International processingSome of the technology providers used by DearTales may process or store information outside the United Kingdom.Where international processing takes place, the provider’s own privacy terms and applicable data-transfer protections apply.DearTales seeks to use reputable providers and to minimise the personal information shared with them.You may contact us if you would like further information about the providers used to create your particular order.13. SecurityWe take reasonable steps to protect the information entrusted to us and limit access to personal information to what is reasonably necessary to operate DearTales and fulfil orders.However, no online service or method of electronic storage can be guaranteed to be completely secure.14. Your data protection rightsDepending on the circumstances and the lawful basis being used, UK data protection law may give you the right to ask for access to personal information we hold, ask us to correct inaccurate information, ask us to erase information in certain circumstances, ask us to restrict how information is used, object to certain uses of personal information, receive certain information in a portable format, and withdraw consent where processing is based on consent.To exercise a privacy right, email [email protected].We may need to verify your identity before responding to a request.15.
